Acceptance of Terms

By accessing, registering for, or using any services provided by partylzslq B.V., you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

These terms constitute a legally binding agreement between you and partylzslq B.V., a company registered in the Netherlands with registration number 16398572 and VAT number NL795246831B134.

Company Information

partylzslq B.V. operates a wellness studio located at Schoolstraat 164, 1387 WS Almere, Flevoland, Netherlands. We provide fitness training, wellness consultations, nutrition coaching, and related health and wellness services.

Service Description

partylzslq provides the following services:

• Personal fitness training and coaching
• Group fitness classes and programmes
• Wellness consultations and health assessments
• Nutrition coaching and meal planning
• Access to fitness facilities and equipment
• Online resources and digital wellness tools

All services are provided subject to availability and may be modified or discontinued at our discretion with reasonable notice.

User Obligations

As a user of partylzslq services, you agree to:

• Provide accurate and complete information during registration and health assessments
• Maintain the confidentiality of your account credentials
• Follow all safety guidelines and instructions provided by our staff
• Respect other members and maintain appropriate behaviour in our facilities
• Inform us of any health conditions or changes that may affect your ability to exercise safely
• Pay all fees and charges in accordance with your membership or service agreement
• Use our facilities and equipment responsibly and in accordance with posted rules
• Not engage in any illegal, harmful, or disruptive activities on our premises

Health and Safety

Your health and safety are our priority. By using our services, you acknowledge and agree that:

• You are physically capable of participating in fitness activities
• You will consult with healthcare professionals before beginning any new exercise programme
• You will immediately report any injuries or health concerns to our staff
• You understand that physical exercise involves inherent risks
• You will follow all safety protocols and equipment usage guidelines
• You will not use our services if you have any contagious illnesses

Membership and Payment Terms

Membership fees and payment terms are as follows:

• Membership fees are due in advance according to your chosen payment schedule
• All prices are in Euros and include applicable VAT
• Payment methods include bank transfer, credit card, and direct debit
• Late payment may result in suspension of services and additional charges
• Membership benefits and pricing may be modified with 30 days notice
• Refunds are processed according to our cancellation policy

Cancellation and Termination

You may cancel your membership or services subject to the following conditions:

• Monthly memberships: 30 days written notice required
• Annual memberships: Subject to specific terms in your membership agreement
• Personal training packages: 48 hours notice required for individual session cancellations
• Group classes: 24 hours notice required for cancellations
• We reserve the right to terminate memberships for violation of these terms
• Termination for cause may result in forfeiture of prepaid fees

Intellectual Property

All content, materials, and intellectual property related to partylzslq services are owned by partylzslq B.V. or our licensors. This includes but is not limited to:

• Training programmes and methodologies
• Written materials, videos, and digital content
• partylzslq trademarks, logos, and branding
• Software applications and digital platforms
• Proprietary fitness and wellness protocols

You may not reproduce, distribute, modify, or create derivative works from our intellectual property without explicit written permission.

Privacy and Data Protection

Your privacy is important to us. The collection, use, and protection of your personal data are governed by our Privacy Policy, which forms part of these terms. By using our services, you consent to the processing of your personal data as described in our Privacy Policy.

We comply with the General Data Protection Regulation (GDPR) and Dutch data protection laws in all our data processing activities.

Limitation of Liability

To the maximum extent permitted by law, partylzslq B.V. shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to:

• Personal injury or property damage (except where caused by our negligence)
• Loss of income, profits, or business opportunities
• Emotional distress or psychological harm
• Failure to achieve fitness or wellness goals
• Interruption or suspension of services due to circumstances beyond our control

Our total liability for any claim shall not exceed the amount of fees paid by you for the specific service giving rise to the claim during the 12 months preceding the incident.

This limitation does not affect your statutory rights as a consumer under Dutch law or EU regulations.

Indemnification

You agree to indemnify and hold harmless partylzslq B.V., its directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of our services in violation of these terms
• Your negligent or intentional misconduct
• Your violation of any third-party rights
• Any false or misleading information you provide to us

Force Majeure

partylzslq shall not be liable for any failure to perform its obligations under these terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, government regulations, pandemics, strikes, or technical failures.

In such cases, we will make reasonable efforts to resume services as soon as possible and may offer alternative arrangements or membership extensions where appropriate.

Governing Law

These terms of service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the Dutch courts.

For consumer contracts, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.

Dispute Resolution

We encourage the amicable resolution of any disputes. Before initiating formal legal proceedings, please contact us to discuss any concerns or issues. Many disputes can be resolved through direct communication.

If you are a consumer, you may also have the right to use alternative dispute resolution services or file complaints with relevant consumer protection authorities.

Modifications to Terms

partylzslq reserves the right to modify these terms of service at any time. We will provide notice of material changes by:

• Posting updated terms on our website
• Sending email notifications to registered members
• Providing notice at our facility

Continued use of our services after notice of changes constitutes acceptance of the modified terms. If you do not agree to the changes, you may cancel your membership in accordance with our cancellation policy.

Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

Entire Agreement

These terms of service, together with our Privacy Policy and any specific service agreements you may have with partylzslq, constitute the entire agreement between you and partylzslq B.V. regarding the use of our services.
